Terms of Service

The agreement between you (the customer) and Bcreate Systems, doing business as YinPsi. By creating a workspace, you agree to these terms.

1. Who is responsible for what

YinPsi is operated by Bcreate Systems (Trivandrum, India). You access YinPsi as the workspace administrator for the business you represent and you confirm you have authority to bind that business to these terms.

2. Your account

  • You are responsible for keeping your login credentials confidential.
  • You may invite team members ("agents"); each user agrees to these terms by accepting the invitation.
  • You are responsible for all activity in your workspace, including actions taken by AI agents you have configured.

3. Acceptable use

You agree not to use YinPsi to:

  • Send unsolicited bulk messages to people who have not consented to receive them via WhatsApp.
  • Bypass or attempt to bypass Meta WhatsApp Business policies, including conversation-window restrictions, template-category rules, and quality-rating systems.
  • Send spam, phishing, hate speech, harassment, sexual content, content harmful to minors, or content that promotes illegal activity.
  • Impersonate another business or person.
  • Probe, scan, or test the vulnerability of our infrastructure without prior written consent (responsible disclosure to security@yinpsi.com is welcome).
  • Resell, white-label, or sub-license YinPsi without an explicit agreement (white-label is available on enterprise plans).

We may suspend or terminate your workspace if we observe a credible violation. We will tell you why, and except for violations that risk immediate harm we will give you 24 hours to remediate before suspension. Full rules are in our /acceptable-use policy.

4. WhatsApp / Meta terms

YinPsi integrates with the Meta WhatsApp Business Platform. Your use of WhatsApp through YinPsi is also subject to Meta's policies, including:

Meta charges conversation fees directly on your WABA invoice. YinPsi adds zero markup to those fees — see /pricing. You are solely responsible for paying Meta’s conversation fees through your connected WhatsApp Business Account.

5. AI features

  • AI output is suggested, not guaranteed. Replies, summaries, translations, drafts, and any other AI-generated content may be inaccurate, biased, or out of date. You are responsible for reviewing AI output before relying on it or sending it to your customers.
  • Destructive actions require human confirmation. AI Agents do not autonomously send payments, create orders, or take other destructive actions without a confirmation step from a human in your workspace.
  • AI features count against per-plan reply limits. Overages are billed at the rate stated on the pricing page (currently US$5 per 1,000 additional replies).
  • Content you send to AI features is processed by the sub-processors listed on our /security page and is subject to our /privacy policy.

6. Billing

  • All paid plans bill monthly in advance. There is no annual lock-in.
  • India billing is handled by Razorpay (INR). All other countries are handled by Stripe (USD).
  • Cancellation is effective at the end of the current billing cycle. Your workspace stays active until then; no further charges are billed after. You may also opt for an immediate cancellation with no refund.
  • A failed payment puts your subscription into a 7-day grace period during which we retry the payment up to three times. After 7 days of failed billing, the account moves to a read-only state until billing is restored.
  • Refunds: we do not offer pro-rata refunds for partial months. If you believe a charge is in error, email billing@yinpsi.com within 14 days and we'll review case-by-case. See our /refund policy.
  • Taxes (GST, VAT, sales tax) are calculated based on your billing address and itemised on your invoice.

7. Content ownership

You retain all rights to the content you upload into YinPsi (contacts, templates, messages, workflows). We claim no ownership over your data — we hold it as your data processor (see /privacy).

8. Warranty disclaimer

YinPsi is provided "as is." We work hard on reliability — we publish our uptime publicly at /status — but we do not warrant that the service will be uninterrupted, error-free, or fit for any particular purpose beyond what is documented.

9. Limitation of liability

To the maximum extent allowed by law, YinPsi's aggregate liability arising from or related to these terms is limited to the greater of:

  • The amount you paid YinPsi in the 12 months preceding the event giving rise to the claim, or
  • US$100.

We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption, even if foreseeable. Some jurisdictions do not allow such limits; in those, the broadest limit permitted by law applies.

10. Suspension and termination

  • You may cancel any time from settings; cancellation is effective at the end of the billing cycle.
  • We may suspend or terminate your account immediately for material breach of acceptable use, for non-payment after the grace period, or as required by law or by Meta.
  • On termination, we delete your data within 30 days, except for billing records and audit logs that must be retained for legal compliance.

11. Changes to these terms

We may update these terms. Material changes are notified via WhatsApp and email 30 days in advance. Continued use after a change takes effect constitutes acceptance.

12. Governing law

These terms are governed by the laws of India. Any dispute that cannot be resolved by good-faith discussion is subject to the exclusive jurisdiction of the courts of Trivandrum, Kerala.
